Terms of Service

1. Who we are
Habitude (“the Service”) is operated by HabitTracker (“we”, “us”, “our”). By creating an account or using the Service you are entering into an agreement with HabitTracker.
2. Acceptance of these terms
By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service. Your continued use constitutes ongoing acceptance of any updates we publish here.
3. Eligibility and account
You must be of legal age in your jurisdiction to enter into a contract. You are responsible for keeping your account credentials confidential and for all activity under your account. Provide accurate information and keep it up to date.
4. Acceptable use
You agree not to misuse the Service. In particular, you will not:
- use the Service for any unlawful purpose, fraud, or spam;
- infringe the intellectual property or privacy rights of others;
- introduce malware, attempt to probe, scan, or breach our security; or
- scrape, reverse engineer, or attempt to circumvent technical limits of the Service.
5. Intellectual property
HabitTracker retains all right, title, and interest in and to the Service, including all software, designs, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service within your chosen plan. You retain ownership of habit data you create; you grant us a limited license to host and process it solely to provide the Service.
6. Payment, subscriptions and taxes
Paid plans are billed in advance on a recurring basis at the price shown on our Pricing page, excluding any applicable taxes. Subscriptions renew automatically until cancelled. Detailed payment, billing, tax, cancellation and refund mechanics are governed by our reseller’s Buyer Terms, available at paddle.com/legal/checkout-buyer-terms. Refund requests are covered by our Refund Policy.
7. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
8. Service availability
We work hard to keep the Service running, but we do not guarantee uninterrupted or error-free performance. Features may change as we improve the product.
9. Suspension and termination
We may suspend or terminate your access to the Service for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service and cancel your subscription at any time.
10. Disclaimers and liability
To the fullest extent permitted by law, the Service is provided “as is” without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose. Our aggregate liability for any claim arising out of or relating to the Service is capped at the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by updating the “Last updated” date above and, where appropriate, by notice within the Service.
